These Terms & Conditions govern your access to and use of the Ellect Fashion website and the purchase of any products from us. By using this website and/or placing an order, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use this website.
1. About Us
This website is operated by Ellect Pty Ltd (referred to as “Ellect”, “we”, “us”, “our”).

Where applicable, we partner with Real Time Fashion for measurement technology and certain production and logistics services.
2. Our Services & Products
Ellect offers both:
- Stock Products – garments created to standard sizing, made to order based on set measurements; and
- Custom / Made to Order Products – garments created specifically to your body measurements using 3D body scanning and/or other fit analytics.
We provide detailed product descriptions and, where available, 3D visualisations on the website.
While we make every effort to display colours and details accurately, the colours you see will depend on your device settings and screen. As a result:
- The actual product colour and appearance may differ slightly from what you see online.
- Variations in manufacturing processes and materials may also result in minor differences between the product delivered and the product displayed on the website.
All products and fabrics are subject to availability. If a product you ordered is no longer available, we will:
- Inform you as soon as reasonably possible; and
- Offer an alternative product of equal or higher quality or value (if you agree), or a suitable remedy in line with Australian Consumer Law.
We reserve the right to update, modify, or remove content, products, or services on the website at any time without notice.
3. Pricing & Currency
Australia
- All prices for orders shipped within Australia are in Australian Dollars (AUD).
- Prices are inclusive of GST, relevant customs duties, and any other applicable taxes or levies.
International
- All prices for orders shipped outside Australia are in United States Dollars (USD).
- Prices include relevant sales taxes, customs duties, and other applicable charges, where indicated.
We may update prices from time to time. The price you pay is the price displayed at checkout at the time you place your order.
4. Placing an Order
To place an order, you must:
- Be at least 18 years of age or have the consent of a guardian;
- Provide accurate and complete information; and
- Use a valid payment method that you are authorised to use.
Your order is accepted only when:
- You have completed the checkout process correctly; and
- We have received authorisation from your payment provider; and
- We issue an Order Confirmation (by email).
We reserve the right to cancel or refuse any order where:
- Payment is not authorised;
- There is an error in pricing or product description;
- The product is unavailable; or
- We reasonably suspect fraud or misuse.
5. Shipping & Delivery
We ship Australia-wide and internationally from Australian and/or China–sourced materials and factories operating under monitored ethical and humane employment practices.
Delivery charges, thresholds for free shipping, and estimated delivery times are shown at checkout and may vary by country.
As a guide:
Australia
- Stock Orders: Typically delivered within 7–14 business days from Order Confirmation (after payment is received).
- Custom / Made to Order: Typically delivered within 21–30 business days from Order Confirmation.
International
- Stock, Pre-Order & Custom / Made to Order: Usually delivered within 21–30 business days from Order Confirmation.
You will receive an email with a tracking number once your order has shipped.
Ellect guarantees delivery except in circumstances beyond our reasonable control (e.g. force majeure events, extreme weather, incorrect shipping information, public holidays, carrier issues, customer not available, legal restrictions, etc.).
Please ensure you provide:
- A correct and complete delivery address; and
- A valid contact number.
We cannot be responsible for loss, delay or non-delivery where you have supplied incorrect or incomplete details.
6. Returns, Exchanges, Credits & Refunds
All return, exchange, credit or refund requests must be submitted in writing.
- For Stock Orders and Custom / Made to Order Products, you must notify us within 7 days of delivery if you have a concern.
- All garments must be returned in the exact condition they were delivered:
- Unworn (except for trying on),
- Unwashed,
- Unaltered,
- With all original tags and labels attached.
Unless otherwise stated, return shipping costs are the customer’s responsibility. Original shipping charges are non-refundable.
All claims are handled in accordance with Australian Consumer Law.
7. Stock Orders (Standard Size)
If you are not satisfied with a Stock Product:
- Email your request within 7 days of delivery, including:
- Your name, order number and Customer ID;
- The item(s) you wish to return; and
- Photos and a brief description showing the reason for your concern.
- If your request is approved, you will receive a Return Authorisation (RA) number and return instructions.
- The product must be received by us within 14 days of delivery (based on your original delivery date).
If approved, you may receive (subject to assessment):
- A credit,
- An exchange, or
- A refund, in line with our obligations under Australian Consumer Law.
Important:
- We do not accept exchanges on Sale products.
- All exchanges are shipped at the customer’s cost.
- Refunds will be made to the original payment method only.
We process approved claims within 1–2 business days of receiving the garment, though it may take up to 10 business days for funds to appear in your account.
8. Custom / Made to Order Products – Fit Guarantee
Custom / Made to Order garments are made specifically and uniquely for you, and generally have no commercial value to other customers. For that reason, we cannot accept change-of-mind returns on these garments.
However, Ellect offers a Fit Guarantee on all Custom / Made to Order Products.
If you are not happy with the fit or believe there is a manufacturing fault:
- Notify us in writing within 7 days of delivery, including photos and a description of the issue.
- We will contact you within 3 business days to discuss the issue and next steps.
We may then:
- Ask you to return the garment to us for further assessment; and/or
- Ask you to visit a local tailor, dressmaker or alterations shop to obtain a written quotation detailing all alterations required, including contact details for the tailor.
Once we have reviewed the information, we may:
- Approve and reimburse reasonable alteration costs directly to the tailor/dressmaker; and/or
- Request that you return the garment to us; and if it cannot be altered or remedied, we may:
- Remake and deliver a new garment at no cost to you; or
- Provide a credit for the garment’s original value; or
- Provide a refund of the garment’s original value.
Fit issues and faults must be genuine and within the scope of our Fit Guarantee (faulty manufacture, faulty components, or faulty fit attributable to us). We reserve the right to repair or remake where appropriate.
All returned garments must be in original condition, unworn (other than to try on), unwashed, unaltered, with all tags attached.
9. Order Cancellations & Changes
- Cancellations: We may cancel an order where we cannot deliver the product as ordered (for example, due to fabric being out of stock or production constraints). In such cases, you may be offered an alternative product, store credit, or a refund.
- Changes: Changes to an order may be possible depending on where it is in the production process. Additional costs may apply if extra time, materials or work are required.
Please contact us as soon as possible if you wish to request a change.
10. Ethical Brand & Manufacturing
Ellect is committed to ethical and responsible production. Our partner factories:
- Provide clean, safe and comfortable working environments;
- Pay fair wages with appropriate medical and retirement contributions; and
- Offer sustainable, long-term employment rather than short-term exploitation.
We are committed to sweatshop-free labour practices and aim to maintain this standard in all our production relationships.
11. Intellectual Property
All content on the Ellect website, including but not limited to:
- Logos, trademarks, brand names, designs and layouts;
- Text, images, graphics, icons, videos, and data;
- Software, code, and digital assets;
is owned by or licensed to Ellect and is protected by applicable intellectual property laws.
You may access and use the website and its content for personal, non-commercial use only.
Without our prior written consent, you must not:
- Copy, reproduce, modify, distribute, republish, upload, post, or publicly display any content;
- Use any content for commercial purposes;
- Frame or link to our website in a way that suggests association, approval or endorsement where none exists.
Any unauthorised use of our content may result in legal action.
12. Customer Obligations
When using our website, you agree to:
- Provide truthful, accurate and up-to-date information;
- Not misuse the website or interfere with its normal operation;
- Not upload or transmit any material that is defamatory, offensive, obscene, threatening, discriminatory, or otherwise unlawful;
- Not introduce viruses, malware, or other harmful code;
- Not infringe the intellectual property or privacy rights of others;
- Not use the website for unauthorised advertising or commercial purposes;
- Not impersonate any person or misrepresent your affiliation with any person or organisation.
We reserve the right to suspend or terminate access to the website or services for users who breach these obligations.
13. Links to Other Websites & Social Media
Our website may contain links to third-party websites or social media platforms. These links are provided for convenience only.
- We do not control and are not responsible for the content, products or services offered on third-party sites.
- Accessing any linked site is at your own risk and subject to that site’s terms and policies.
Similarly, comments, images, videos and other material posted by third parties on social media (e.g. Facebook, Instagram, LinkedIn, YouTube) do not necessarily reflect the views of Ellect. All such content must comply with both our terms and the terms of the relevant platform.
14. Cookies
Our website uses cookies to improve your experience. Cookies are small text files stored on your device that help us:

- Store information about your preferences;
- Simplify searches and navigation;
- Recognise you when you return to the site.

- Manage payments, returns and complaints;
- Confirm your identity and address with trusted partners;

We do not sell or exchange your personal data with third parties outside the Ellect group and its trusted partners, except as required to provide our services or as required by law.
By using this website, you consent to the processing of your personal data as described in our Privacy Policy.
16. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for any indirect, incidental, special or consequential loss or damage arising out of or in connection with your use of the website or products purchased, including but not limited to loss of profits, loss of opportunities, or loss of data.
- Our total liability in connection with any product or service supplied is limited, at our option, to:
- The replacement of the product or supply of equivalent product;
- The repair of the product;
- The payment of the cost of replacing or repairing the product; or
- Any other remedy required by Australian Consumer Law.
Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under Australian Consumer Law or any other applicable law that cannot be excluded.
17. Governing Law
These Terms & Conditions are governed by the laws of New South Wales, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.
18. Changes to These Terms
We may update these Terms & Conditions from time to time. The latest version will always be available on this website and will apply from the date it is posted.
Your continued use of the website and/or purchase of products after any changes means you accept the updated Terms & Conditions.
